Plummark is a professional service assisting clients with trade mark applications and brand protection. We operate via Plum Mark Pty Ltd (ABN 45 686 778 405) in Australia and Plum Mark Ltd in the UK. 
 
While we help with trade mark registrations and related services, we are not a law firm. Any legal content is general information only and not legal advice. 

You may use the site for personal or business purposes to explore and engage our services. You agree not to: 
- Misuse the website or engage in unlawful activity 
- Copy, reproduce or distribute website content without permission 
- Submit false or misleading information 
- Attempt to interfere with our website’s functionality or security 

All content on this website—including logos, brand names, graphics, text, and layout—is the property of Plummark or its licensors and is protected by intellectual property laws. You must not use or replicate this content without prior written consent. 

Prices for our services are listed on the website and may be updated from time to time. All fees are in Australian dollars (AUD) unless stated otherwise and are inclusive or exclusive of GST as specified. 
 
Submitting a form or payment does not guarantee the successful registration of your trade mark. Government filing fees and eligibility rules apply. 

We use Stripe as our third-party payment processor. By submitting your payment, you agree to Stripe’s Terms and our refund policy. We may refuse or cancel orders where there is an issue with payment or suspected misuse. 

Due to the nature of our services, which involve professional time and submission of information to third-party government bodies, refunds are not generally available once work has commenced. If you believe you have been charged in error, please contact us at support@plummark.com.au. 
 
In accordance with Australian Consumer Law, you may be entitled to a refund or remedy in certain circumstances. 

To the maximum extent permitted by law, Plummark limits its liability for the supply of services to one or more of the following, as determined by us: 
- the supplying of the services again; or 
- the payment of the cost of having the services supplied again. 
 
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law (ACL) which cannot be lawfully excluded. This clause is intended to operate in accordance with section 64A of the ACL. 

The website may contain links to third-party sites. These are provided for your convenience and do not imply endorsement. We are not responsible for the content or accuracy of any external site. 

We may update these Terms at any time without notice. Continued use of the website after changes are made constitutes your acceptance of the updated Terms. 

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of that state.
